Information We Collect. We may collect the following personal information from you and about you and your use of the Services, including directly from you, indirectly from you via your use of the Services, from third parties and our business partners, or from publicly available sources:
- Personal identifiers, such as name, address, email, date of birth, phone number, and other identifiers
- Demographic information, such as gender, age, or zip code
- Device and usage data, such as browser type, browser version, webpages visited, content viewed, device identifiers, and IP address.
- Financial and transaction information, such as information about your financial situation and activity, including income, assets, liabilities, account balances, investment holdings, transaction history, financial goals, and any information about products or services you obtain from us
- Geolocation information, which we can sometimes determine indirectly from our IP address
- Inferences drawn from your use of the Services, including your preferences

Why We Collect and How We Use Information. We collect and use personal information for the following purposes, which may include purposes necessary to provide the Services (primary purposes) and additional purposes that are compatible with those purposes or otherwise permitted by applicable law (secondary purposes)
- Primary Purposes: To provide our products and services to you, including to set up your account(s); establish that you are of legal age to use the Services; and respond to questions and requests by clients and business partners.
- Secondary Purposes: Analyze, manage, and improve the Services, including analyzing preferences; improve our Services; develop and implement new products, services or features; detect, investigate and prevent fraud and other crimes, or to otherwise protect or exercise our legal rights; respond to requests from law enforcement or for any other purpose, or in connection with, any legal proceedings (including prospective legal proceedings); create a profile that allows us to provide you customized suggestions for our Services; advertise and communicate with you, including providing you information about our Services, or the services and products of our partners; and help us protect the Services and our clients and partners.
We process personal information for the purposes described above in accordance with applicable law. Depending on your jurisdiction, our processing may be based on one or more of the following:
- Performance of a contract, where processing is necessary to provide the Services to you or fulfill our contractual obligations
- Consent, where you have provided consent to the processing for one or more specific purposes, which you may withdraw at any time

- Legal claims, where processing is necessary to establish, exercise, or defend legal rights; or

Disclosing and Sharing Personal Information. We may share information with third parties in order to provide the Services to you and for our internal business purposes, including for the following purposes:
- Sharing with Business Partners. We may share information with business partners to provide and improve the Services. We may share information about you with third-party partners with whom we collaborate to provide you with our products and services.
- Sharing with Service Providers Acting on Our Behalf. We may share information with service providers we use to assist us in providing the Services to you and/or to perform on our behalf any of the activities we are permitted to conduct under this Privacy Policy. We may also share with third parties deidentified or aggregated data that we collect. We share such information for a variety of purposes, including to monitor and understand your use of the Services and to improve the Services.
- Sharing to Complete a Transaction. We may share information with other third parties if there is a specific need to complete a transaction requested by you.
- Sharing with Affiliates. - Sharing with Employees. We may share information with our employees in order to respond to your requests or inquiries. Certain employees will also be provided with information to monitor the effectiveness of the Services. Our employees are required by written confidentiality agreements, corporate policies, and applicable law to maintain the confidentiality of personal information and to use strict standards of care in handling personal information.
- Sharing with Third Parties as Part of a Business Transaction. We may disclose and transfer information to a third party as part of a business transaction, such as a merger, acquisition, divestiture, restructuring, reorganization, dissolution, or sale of all or a portion of our assets.
- Sharing with Third Parties for Legal Reasons. We may disclose your information to comply with any applicable laws and/or regulations, such as to comply with valid legal processes such as a search warrant, subpoena, or order from a court or tribunal of competent jurisdiction.

No mobile information will be shared with third parties/affiliates for marketing/promotional purposes without consent.
Creative Planning may share anonymous data with third parties, such as service providers or business partners, in order to facilitate our business operations.

You have the right to request that we disclose the categories of personal information we collected about you, the categories of sources from which we collected the personal information, the categories of personal information that we sold or disclosed, our business or commercial purpose for collecting and selling your personal information, the categories of third parties with whom we shared your personal information, and the specific pieces of personal information we collected about you.
- Right to Correct. You have the right to request in certain circumstances that we correct any inaccurate personal information that we have collected directly from you. To protect your personal information, we are required to verify your identity before we can act on your request. You may also update your information, as described in the “Updating Your Information” section.
- Right to Delete. You have the right to request that we delete the personal information we have collected about you, subject to certain exemptions.
- Right of Data Portability. You have the right to request a portable copy of your personal information, to the extent technically feasible, in a readily accessible format.
- Right to Withdraw Consent. You have the right at any time to withdraw consent previously given. Note that the withdrawal of consent does not affect the lawful processing of your personal information that occurred prior to such withdrawal.
- Right to Opt-Out or Restrict. You have the right to opt-out of, limit, or restrict certain uses of your personal information (e.g., targeted advertising, sale, sharing or profiling).
- Non-Discrimination. You have the right not to be discriminated against for exercising the rights above.
- Limit Use. You have the right to limit use of sensitive personal information.
- Right to Lodge Complaint. You have the right to lodge a complaint with your local data protection authority. If you are in the European Economic Area (EEA), Switzerland, or the United Kingdom (UK), you may lodge a complaint (but before doing so, please tell us your concerns so that we can try to solve them). We will honor rights in accordance with applicable law. Creative Planning will take steps to verify your identity before processing your request. We may not fulfill your request unless you have provided sufficient information for us to reasonably verify you are the individual about whom we collected personal information. We will only use the personal information provided in the verification process to verify your identity or authority to make a request and to track and document request responses, unless you initially provided the personal information for another purpose. If we cannot verify your identity to comply with a request, we will explain the reason in our communication to you.
You may use an authorized agent to submit a request. When we verify your agent’s request, we may verify both your and your agent’s identity and request documentation from you that authorizes your agent to make the request on your behalf. To protect your personal information, we reserve the right to deny a request from an agent that does not submit proof that they have been authorized by you to act on their behalf.
Updating Your Information. You may submit a request to update your personal information by emailing compliance@creativeplanning.com. We may require additional information from you to allow us to confirm your identity. Please note that if you ask us to remove information, we will remove it from the Services but may continue to store and use the information as permitted under applicable law. We will retain and use your information as necessary to comply with our legal obligations or data retention policies, resolve disputes, and enforce our agreements.
Promotional Communications.
- Emails. You may opt-out of receiving marketing or promotional emails from us at any time by following the unsubscribe instructions included in such emails or by contacting us using the information provided in the “Contact Us” section below. Please note that you may continue to receive non-promotional communications from us, such as those relating to your account, transactions, servicing, or our ongoing business relationship, to the extent permitted by applicable law. Your opt-out request will apply to the email address used to submit the request and may not affect future subscriptions. Where we engage third parties to send communications on our behalf, you may opt out of such communications through the methods described above. If you receive marketing communications directly from a third party, you should follow that third party’s opt-out instructions. Where required by applicable law, we will obtain your consent before sending you marketing communications, and you may withdraw your consent at any time.
- Text messages and phone calls. You may opt out of receiving marketing text messages or calls from us at any time by following the instructions provided in such communications, including by replying “STOP” to a text message where applicable, requesting to opt out during a call, or contacting us using the information in the “Contact Us” section below. Where required by applicable law, we will obtain your consent before sending marketing text messages or making marketing calls, and you may withdraw your consent at any time. Please note that you may continue to receive non-marketing communications (such as service-related messages, security alerts, or transaction notifications) to the extent permitted by applicable law. International Transfers. We are based in the United States, which may offer different levels of privacy protection than your country of residence. If you are accessing the Services from outside of the U.S., please be aware that information collected through the Services may be transferred to, processed, stored, and used in the U.S. and other jurisdictions. Where required by applicable law, we implement appropriate safeguards to protect personal information when it is transferred internationally. These safeguards may include:

Analytics and Internet-Based Advertising. We use analytics and advertising partners to help us understand how users interact with the Services. Do We Respond to Do Not Track Signals? Do Not Track (“DNT”) is a privacy preference that users can set in certain web browsers and is a way for users to inform websites and services that they do not want certain information about their webpage visits collected over time and across Sites or online services.
We do not track users across time or over multiple websites, we do not receive, or respond to, browser do-not-track signals or other similar mechanisms. However, some third party sites do keep track of your browsing activities when they serve you content, which enables them to tailor what they present to you.

Automated Decision-Making and Profiling. We do not rely on artificial intelligence (“AI”) for financial research and decision-making. Where approved, we may use AI and automated tools to support and enhance our processes, including research, analysis, operational efficiency, and service improvements, subject to appropriate human oversight.
We conduct initial and ongoing due diligence of service providers that process or store personal information on our behalf. Where a provider uses AI or automated processing, our due diligence and monitoring may include an assessment of (i) privacy and data protection practices, (ii) information security controls, (iii) data usage and training practices (including restrictions on use of data), (iv) reliability, accuracy, and risk of bias (as applicable), and (v) compliance with appliable laws and contractual obligations. We require our service providers to meet our contractual, privacy, and security standards and to implement appropriate safeguards when using AI or similar technologies.
Links to Third Party Sites. The Services may contain links to third party websites. When you click on a link to any other website or location, you will leave our Services and go to another site and another entity may collect personal and/or anonymous information from you. Our provision of a link to any other website or location is for your convenience and does not signify our endorsement of such other website or location or its contents. We have no control over, do not review, and cannot be responsible for, these outside websites or their content. Please be aware that the terms of this Privacy Policy do not apply to these outside websites. We encourage you to read the privacy policy of every website you visit.
Security of Your Information. Creative Planning and its affiliates maintain a comprehensive information security program designed to ensure the security and confidentiality of customer information, protect against threats or hazards to the security of such information and prevent unauthorized access. This program includes:
- Procedures and specifications for administrative, technical and physical safeguards.
- Security procedures related to the processing, storage, retention and disposal of confidential information.
- Programs to detect, prevent and, when necessary, respond to attacks, intrusions or unauthorized access to confidential information.
- Restricting access of personal information to employees who need to know that information to provide products and services to you and appointing specific employees to oversee our information security program.
These safeguards are designed taking into account the nature of personal information and the risks associated with its processing. However, no method of transmission over the internet or method of electronic storage is completely secure. While we strive to protect personal information, we cannot guarantee absolute security.
Retention of Personal Information. We will retain your personal information for as long as necessary to fulfill the purposes for which it was collected, as described in this Privacy Policy, and in accordance with applicable law. Different types of personal information may be retained for different periods depending on the nature and purpose of the processing. The criteria used to determine retention periods may include:
- The duration of our relationship;
- Whether we have a legal, regulatory, or contractual obligation to retain the information;
- Whether retention is advisable in light of applicable statutes of limitation, legal claims, or disputes; and

When we no longer have a legitimate need to process your personal information, we will delete or anonymize it using methods designed to prevent unauthorized access, disclosure, or reconstruction, in accordance with applicable law and our internal data retention policies. Where anonymization is used, the information will no longer be associated with you and will not be treated as personal information. If deletion or anonymization is not immediately possible (for example, because the personal information is stored in backup systems), we will securely store the information and isolate it from further processing until deletion is possible.
Children. Our Services are not directed to children under the age of 18 years. By using our Services, you represent and warrant that you are at least 18 years old.
We respect the privacy of children and do not knowingly collect or retain personally identifiable information or nonpublic information from children under the age of 18 through our Site(s). However, we may process nonpublic information, on a child’s behalf, with permission from the parent or guardian.
To the extent we have unintentionally collected any nonpublic information on our Site(s) from a person under the age of 18 years old, you may request and obtain removal of this nonpublic information. Creative Planning reserves the right to modify this Privacy Policy at any time by posting the revised version on this website and updating the “last updated” date above. Any such changes to this Privacy Policy will become effective upon posting. We will provide each client with initial notice of the current Privacy Policy when the client relationship is established. We will also provide each client with the current Privacy Policy at least annually.

Supplemental U.S. State Privacy Rights (Including California)
Residents of certain U.S. states, including California, Colorado, Connecticut, Delaware, Indiana, Iowa, Montana, Oregon, Tennessee, Texas, Utah, Virginia, and other states with applicable privacy laws, may have certain rights regarding their personal information, subject to applicable exceptions and limitations.
Certain personal information we collect is subject to the federal Gramm-Leach-Bliley Act (“GLBA”) and implementing regulations. This Privacy Policy does not apply to personal information that is collected, processed, sold, or disclosed pursuant to the GLBA to the extent such information is exempt under applicable state law.
Your Rights. Depending on your state of residence, you may have the right to:
- Access the personal information we maintain about you
- Correct inaccuracies in your personal information
- Delete your personal information
- Obtain a copy of your personal information in a portable format
- Opt out of (i) the sale of personal information; (ii) the sharing of personal information for targeted advertising; and (iii) certain forms of profiling or automated decision-making, where applicable
Categories of Personal Information. In the past twelve (12) months, we have collected the following categories of personal information:
- Identifiers – name, address, social security number, birthdate
- Personal Information (Cal. Civ. Code § 1798.80(e) and similar state laws)
- Protected classification characteristics under state or federal law
- Commercial Information – transaction history, products or services used
- Geolocation Data – approximate location derived from IP address
- Professional or Employment Information – Employer, job title
- Inferences – Preferences, interests, behavioral profiles
- Sensitive Personal Information – Financial account information
Sensitive Personal Information. To the extent we collect “sensitive personal information” as defined under applicable state law, we use such information only for purposes permitted by law, including providing the Services, ensuring security, and complying with legal obligations. We do not use or disclose sensitive personal information for purposes that would require a right to limit its use under applicable law.
Sale of Personal Information. We do not “sell” personal information; however, we may “share” personal information for cross-contextual advertising purposes, as described in the “Analytics and Interest-Based Advertising” section above. To opt out of the sale or sharing of your personal information, please contact us.
Exercising Your Rights. To exercise an access, data portability, or deletion request, please submit a verifiable consumer request to us in one of the following ways:
- Send an email to compliance@creativeplanning.com to inquire as to which elements of your information are possible for us to delete.
- If you would like to close your account, please contact your Wealth Manager.
We may need to verify your identity before processing your request and may request additional information for this purpose.
Making a verifiable consumer request does not require you to create an account with us. However, we do consider requests made through your password protected account sufficiently verified when the request relates to personal information associated with that specific account.
We will only use personal information provided in a verifiable consumer request to confirm the requester’s identity or authority to make the request.
You may designate an authorized agent to submit requests on your behalf, subject to verification requirements. If you would like to designate an authorized agent to submit requests on your behalf, please email us at compliance@creativeplanning.com. Prior to responding to any request made on your behalf by an authorized agent, we may require you to provide written confirmation directly to us that you have provided the authorized agent permission to submit such request(s) on your behalf.
Response Time and Format. We endeavor to respond to a verifiable consumer request within forty-five (45) days of its receipt (or sooner if required by applicable law). If we require more time, we will inform you of the reason and extension period in writing. Any disclosures we provide will only cover the 12-month period preceding the verifiable consumer request’s receipt. The response we provide will also explain the reasons we cannot comply with a request, if applicable.
For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance, e.g., through an Excel or JSON file format.
We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.
Appeals (Where Applicable). If we deny your request or a request made by an authorized agent, you may have the right to appeal our decision, depending on your state of residence. To submit an appeal, please contact us.
Non-Discrimination. We will not discriminate against you for exercising any of your rights. Unless permitted by applicable law, we will not:
- Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties other than for reasons described in our Form ADV Part 2A or Investment Advisory Agreement.
- Provide you a different level or quality of products or services except as otherwise described in our Form ADV Part 2A or Investment Advisory Agreement.
- Suggest that you may receive a different price or rate for products or services or a different level or quality of products or services except as otherwise described in our Form ADV Part 2A or Investment Advisory Agreement.
Creative Planning as a Service Provider. In certain instances, a third party may hire Creative Planning to provide services on behalf of their client. In such case, we process personal information under the direction of that third party as a service provider, and we have no direct relationship with the individuals (investors) whose personal information we process.
Where Creative Planning acts as a service provider, it will collect, retain, use, disclose, and/or otherwise process personal information (i) to fulfill Creative Planning‘s obligations to perform the services pursuant to a written agreement with the third party; (ii) pursuant to a valid business purpose, as permitted by applicable law; and/or (iii) as otherwise directed by the third party in writing. Where Creative Planning processes personal data in the capacity of a service provider, we will not sell that personal information or otherwise retain, use, or disclose personal information for any commercial purpose, except as otherwise directed by the third party in writing.
In addition to the purposes set forth above, Creative Planning may collect, retain, use, disclose, and otherwise process personal information in the context of a service provider to:
- Comply with applicable laws;
- Comply with a civil, criminal, or regulatory inquiry, investigation, subpoena, or summons by federal, state, or local authorities;
- Cooperate with law enforcement agencies concerning conduct or activity that the third party or Creative Planning reasonably and in good faith believes may violate federal, state, or local law;
- Exercise or defend legal claims; and/or
- Collect, use, retain, share, or disclose information that has been aggregated or de-identified, in accordance with applicable law.
Where Creative Planning processes your personal data in the capacity of a service provider, and you seek access, or want to correct, amend, or delete your personal data, or have another request, we will provide you with the third party’s contact information, so you can contact them directly. In rare instances, however, circumstances may necessitate we assist you with your question or request.
